Special Needs Planning

Abney Law, PLLC helps families create long-term plans to help parents of adult children with special needs ensure that their financial assistance does not risk their qualification for important government benefits like SSI, SSDI, or Medicaid.

We prepare Special Needs Trusts that allow families to set aside funds for supplemental care for adult children with disabilities, such as therapies, education, technology, transportation, and other quality-of-life needs, all while preserving eligibility for government benefits. If you are doing an estate plan with us, we take into consideration that an inheritance given directly to your child with special needs could jeopardize their ability to receive benefits. We ensure that the Special Needs Trust is properly funded and that life insurance, real property, and retirement accounts are structured to support your child’s long-term needs.

For parents of adult children with disabilities which make independent living a challenge, we also assist with guardianships and conservatorships. When a child turns 21 in Mississippi, parents lose the automatic authority to make medical, educational, and financial decisions. We help families determine whether guardianship, conservatorship, or another supported decision-making option is appropriate. We guide you through the entire Mississippi GAP Act process, including petitions, physician affidavits, hearings, and annual reports to the court so you can remain legally empowered to protect your adult child.

Our goal is to give you peace of mind by creating a legally sound and compassionate plan that protects your loved one today and in the future. If you would like help preparing a special needs plan for your family, we are ready to guide you every step of the way.
